Required Information for a Valid Claim

Pursuant to 17 U.S.C. § 512(c)(3) and applicable German copyright law, your notice must include:

  • Your full legal name and contact information (email address and, where applicable, physical address)
  • Identification of the copyrighted work that you claim has been infringed (or a representative list if multiple works are involved)
  • The specific URL(s) on MCPETools where the allegedly infringing content is located, with sufficient detail to allow us to find it
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  • Your physical or electronic signature

Note: Claims that are incomplete or do not contain the required information may not be processed. We may request additional information before taking action.

Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  • Your full legal name, address, phone number, and email address
  • Identification of the material that was removed or to which access was disabled, and the URL at which the material appeared before it was removed
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • A statement that you consent to the jurisdiction of the competent court (either the Federal Judicial District in which your address is located, or if outside the United States, the courts of Oldenburg, Germany) and that you will accept service of process from the claimant
  • Your physical or electronic signature

Upon receipt of a valid counter-notification, we will forward it to the original claimant. If the original claimant does not file a court action within 10 business days (or the applicable period under the DMCA), we may restore the removed content.

Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service, MCPETools maintains a policy of terminating the accounts of users who are repeat copyright infringers in appropriate circumstances. If a user's account is associated with multiple valid copyright infringement claims, we may, at our sole discretion, suspend or permanently terminate that user's account and remove all associated content from the platform.

Warning: Filing a false or fraudulent DMCA claim or counter-notification may result in legal liability. Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorney's fees. Under German law, filing a false claim may constitute a criminal offense (falsche Verdächtigung, § 164 StGB) or give rise to tortious liability (§ 823 BGB).

If you are unsure whether certain material infringes your rights, we recommend consulting a legal professional before submitting a claim.
